So our accountant told us the other day that we are not allowed to employ anybody on a self employed basis.

Apparently this is because any self employed worker would be using our gear/vehicles and technically be working under our instruction meaning the only way we can employ anyone is on the books PAYE?

Apparently for someone to be classed as self employed they must work entirely on their own steam with their own tools/materials and transportation?

Surely this is bollox? Anyone know the ins and out of this?
 
Interesting, Basically he is saying their relationship with you may be self employed, but to your client - and the rest of the world they are part of the package you are providing.
It may not be far from reality.

Sounds more like your accountant is telling you company policy.
They can be self employed, providing their own tools and transportation but can still provide a service to your company ie scaffold erection. There is no requirement for that materials to belong to the self employed person.

Similar I would guess to a mechanic providing your company truck with a service whilst using his own tools but not owing the truck

hi boys first post work for small firm 10-14 lads we had to do the same we went through payment agency lads had the hump at first but all good now they have to pay £12 pound a week but all we did was put that bit on top of there wages so they didn't lose out but very easy to sort out with company and they do everything and all you do is pay the invoice they send you once they paid your blokes

First experienced this in the mid 90s, tax man stopping people working on se60 and 715s. Some are still able to be self employed some aren't.
 
You Can Only Be Self Employed If You Fulfill Certain Criteria, You Cannot Only Work For One Firm You Have To Move Around, You Must Provide A Utr Number, You Must Have Public Liability Insurance, You Must Supply Your Own Transport, Tools And PPE, , There Is No Holiday Pay Or Other Benefits,(Kinda Makes You Wonder Why You Bothered Now Doesnt It )
 
Dont panick its not the end of self employement but tbh that may not be far off-Try Hudson contracts service- theyre a payroll company & maybe able to offer you some good advise & service

Been on the same firm for too many years and all scaffs are self employed.. Often wondered how they managed it, but it suits most on here.. I'm talking over 150 scaffs at times !!

I think your accountants right on this one luce. Its been that way for years,tho reality is, suits all party's whether contractor has own plant or not. companys use self employed trades on long term contracts,get out of liabilities by using umbrella co.
